1. Agreement Acceptance
By downloading, installing, or using the Ericall Telecom mobile application or services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

2. Service Description
2.1 Services Provided
- International Outgoing Calls: Mobile application-based calling to international destinations
- Call Display: Your original phone number appears to recipients
- In-App Communication: Voice, video, and messaging between app users
- Account Management: Balance management, call history, and user preferences
2.2 Service Limitations
Important Notice:
- Outgoing Calls Only: No incoming call capabilities
- No Local Canadian Calling: International destinations only
- No Emergency Services: Cannot be used for 911 or emergency calls
- Internet Required: Services require an active internet connection
- Device Compatibility: Compatible devices and operating systems only
3. Account Registration and Verification
3.1 Registration Requirements
- Valid Phone Number: Must provide a working mobile phone number
- SMS Verification: Account activation via OTP (One-Time Password)
- Accurate Information: All registration information must be truthful
- Age Requirement: Must be 18 years or older to register
3.2 Account Security
- Password Protection: Maintain secure account credentials
- Unauthorized Use: Immediately report suspected account compromise
- Account Sharing: Prohibited – accounts are for individual use only
4. Payment Terms and Billing
4.1 Pricing and Payments
- Prepaid Service: Pay-as-you-go credit system
- Rate Information: Current rates available in app and on website
- Payment Methods: Secure online payment processing systems
- Currency: Charges in U.S. Dollars (USD) unless otherwise specified
4.2 Billing Practices
- Real-Time Deduction: Credits deducted during call completion
- Minimum Charge: Minimum billing increments as displayed in app
- Balance Notifications: Low balance alerts via app notification
- Call Records: Detailed usage history available in your account
4.3 Refunds and Credits
- Unused Credits: Refundable within 30 days of purchase (minus processing fees)
- Service Issues: Credits provided for verified service disruptions
- Processing Time: Refunds processed within 5–10 business days
- Refund Method: Original payment method unless otherwise arranged
5. Acceptable Use Policy
5.1 Permitted Uses
- Personal Communication: Individual international calling needs
- Business Communication: Legitimate business communications
- Lawful Purposes: All usage must comply with applicable laws
5.2 Prohibited Uses
You may NOT use our services for:
- Illegal Activities: Any unlawful purposes or activities
- Fraud or Spam: Unsolicited calls, robocalling, or telemarketing
- Harassment: Abusive, threatening, or harassing communications
- System Abuse: Attempts to disrupt or compromise our systems
- Resale: Unauthorized resale of services without proper licensing
- Emergency Calls: 911 or other emergency service calls
5.3 Violation Consequences
- Account Suspension: Temporary or permanent service suspension
- Credit Forfeiture: Loss of remaining account credits
- Legal Action: Cooperation with law enforcement when required
6. Service Availability and Quality
6.1 Service Availability
- Best Effort: Services provided on a best-effort basis
- Network Dependencies: Subject to internet and partner network availability
- Maintenance: Scheduled maintenance may cause temporary service interruption
- Geographic Limitations: Service availability varies by location and destination
6.2 Call Quality
- Factors Affecting Quality: Internet speed, network congestion, device capabilities
- No Guarantees: Call quality depends on factors beyond our control
- Support: Technical support available for service-related issues
7. Intellectual Property
7.1 Our Rights
- Trademarks: "Ericall Telecom" and related marks are our property
- Software: Mobile application and related software are proprietary
- Content: All service-related content is protected by copyright
7.2 Your Rights
- Limited License: Non-exclusive right to use services for personal/business communication
- Restrictions: No copying, modifying, or reverse engineering of software
- User Content: You retain rights to your communications content
8. Privacy and Data Protection

- Call Records: Maintained for service provision and regulatory compliance

9. Liability and Disclaimers

Services provided "as is" without warranties of any kind.
- No Reliability Guarantee: Service availability not guaranteed
- Call Completion: No guarantee all calls will connect successfully
- Quality Disclaimer: Call quality may vary based on network conditions
9.2 Limitation of Liability
Our liability is limited to the amount you paid for services in the last 12 months.
We are not liable for:
- Indirect Damages: Lost profits, business interruption, data loss
- Third-Party Actions: Actions of routing partners or network providers
- Force Majeure: Natural disasters, government actions, network failures
9.3 Emergency Services Warning
Critical Warning: Cannot be used for emergency calls.
- No 911 Access: Services do not provide access to emergency services
- Alternative Required: Maintain alternative means for emergency communication
- No Liability: We are not responsible for inability to reach emergency services
10. Regulatory Compliance
10.1 Canadian Regulations
- CRTC Registration: We are registered with the Canadian Radio-television and Telecommunications Commission
- BITS License: Licensed for Basic International Telecommunications Services
- Privacy Laws: Compliant with PIPEDA and BC PIPA
- Anti-Spam: Compliant with Canada's Anti-Spam Legislation (CASL)
10.2 User Compliance
- Local Laws: Users must comply with laws in their jurisdiction
- Export Controls: Comply with applicable export and import laws
- Regulatory Changes: Service may be modified to maintain compliance
11. Termination
11.1 Termination by You
- Account Closure: Request account closure via customer support
- Refund Policy: Unused credits refunded per our refund policy
- Data Retention: Account data retained as required by law

- Violations: Account termination for Terms violations
- Business Reasons: Service discontinuation with 30 days’ notice

- No Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
- Assignment: We may assign these Terms; you may not assign without our written consent.
